The person I spoke with on the phone said the cases were ONLY shipping with the new ipod videos, and that there was nothing he could offer me.

I 've got my nano last week, without the protective casing and at the time I have placed my order, I was unaware of the problem. I would not have purchased such an expensive gizmo knowing that it had a design flaw.

Now I’ve just got off the phone with 1-800 my apple and I guess the experience with Apple customer service varies from one people to the other. Mine was pretty bad, the person was arrogantly saying that they did not received any directive, she was unwilling to confirm (a) about the scratch problem with nano, (b) that they were shipping new nanos with the protective suit.

Soo I will let the lawsuit against apple progress a little bit, this might give them some clues... and directives.

Yeah, I got the same story...and "we cannot go into details due to legal reasons". Just wondering if the case is really worth it; have a new iPod Nano I haven't even opened caused I just got my InCase armband yesterday with the Plastic Shields, so no since in trying to return it now just for the included case.

I saw the disclaimer on their website now, but don't see the case listed on the contents page under What’s Included:

http://store.apple.com/1-800-MY-APPLE/WebObjects/AppleStore?family=iPodx

So for existing Nano owners, calling up Apple Customer support is of no use?

AppleInsider is reporting interesting things:

"Rumor also has it that Apple has instructed its iPod nano manufacturing partner Hon Hai to include an additional layer of protective coating on the latest batch of nanos."

That would be great. But i think that will be for the second generation of the nanos
Not necessarily. I think it could very well be possible that all new batches have a strengthened cover. Apple won't admit it publicly, though, which means there's no way to know whether you get one with the revised cover or not. However, this is just speculation.

Finally, I've called back 1-800 my apple and referred to a betanews article provided by jeg815. (see a few post above on this thread, you will find it). Guess what, I got the case !

What the #### is this !!! I cannot post the betanews link here for you guys since I am not an "established user".

Anyway, the betanews article mentions that apple's spokeperson confirmed that Nano are now shipped with the case, so they could not say "We do not have any directive bla bla bla".

Did you click one of the number promts when you dialed or just waited till they put you through to an operator?

What department did you ask to speak with?

Thanks

I called 1-800-MY-APPLE and was eventually redirected (after spending close to a half hour on hold) to "an apple product specialist." I referred him to the cnet article and he said that all the news sites are misinformed. I told him to double check, but he gave me a firm no. I'm pretty mad, and don't want to spend another half hour on hold, so please let us know which department you spoke to (or operator) if you successfully get a sleeve out of this.

Thanks!

Does the new case option retroactively apply to those that purchased the Nano before it was adopted in the retail package?

It'd be pretty LAME if they didn't. Hope they learn their lesson with the lawsuit.

Hi jkads3.

What I did is the following: I called 1-800 my apple and selected English then option #2 which is for following up with an order then got an operator almost immediately. My nano was ordered 1.5 week ago directly from the apple web site in Canada. They asked me for my order number and then asked for confirmation of my name and address. Then I asked if I could have a case since the nano are now shipped with case as per the Apple spoke person mentioned in the betanews article. Waited about 10-15 min then the guy agreed to send me the case. The person was much more friendly than the women I have talked with initially. Maybe she was in her "red" day and/or didn't have sex last night, anyway the case is now in the mail and I hope she knows about it.

Hope this helps.
