Question Update Software

Hi guys, I have just spent all night (seven hours) trying to find a solution for the wifes Rightmove App (UK) not downloading on her iPod touch, when you try to download it tells you that you need version 4.0. And according to iTunes (which I have the latest version 10) downloaded the iPod touch has a version 3.1.3, so it tells you to click on the device then go to the option to update software but it just confirms the iPod touch has version 3.1.3, can this iPod touch be updated? I look forward to hearing from you and thanks in advance.

It sounds like she has a first generation iPod touch which will only run up to iOS 3.1.3. The 1G touch only has a Home and a Sleep button where the 2G and up have Volume buttons and a speaker as well.

Thanks Sparkee for your help, yes this is the first generation as you have described that will now explain why I cannot get the update. My thoughts are however that it extremely poor on Apple's part, this will mean as apps get updated it will mean the first generation will become obsolete.
