My refurbished ipod touch 3rd gen WILL NOT restore

I haven't even had it a week. I'm literally pulling my hair out over this one (which is funny because I'm bald), but i was just browsing apps and the display on my touch basically melted. SO I tried to restart it, but it didn't start up so I hooked it up to my computer (Windows XP, with latest iTunes and everything) and tried restoring it but no go. Tried it again and it still would hang at "Preparing your iPod to restore" or whatever, and so I tried probably 10 more times and the just gave up....(sometimes it would actually started restoring it, but stop halfway through and not do anything).

I left it on overnight (it didn't have much battery when it crashed), and connected it to my pc and tried restoring it and voila, it worked. Then I was using it later and it crashed, shutdown, went kaput....again....FML. I've been trying to restore it ever since.

I've tried DFU, recovery mode, saying nice things about it, I'VE DONE EVERYTHING SHORT OF THROWING THIS BREAK AGAINST A FREAKING WALL.

/rant

Anyway... any help would be greatly appreciated. Thanks in advance

UPDATE:

Now I've restored it again, and guess what, 10 minutes into using it, it shuts itself down and goes into recovery mode!!! HOORAY...not

First of all, if you have warranty go for it! Apple gives a 1 year warranty on refurbished products. They'll replace it on the spot.

If not, I would try restoring it from another computer and just put a few apps in to test it out. But if it keeps going into recovery mode, then it maybe a hardware issue.

As Caligirl suggested; take to an Apple store and have it replaced. This is provided you bought it refurbed from Apple. Otherwise, you may be looking at other routes. Have you tried resetting it? Hold the sleep button and the home button down together until the apple logo appears. You will get a shutdown message first, keep holding.
