That won't happen. Apple will just send you a refurbished 40GB unit.

I opted to get this 40gb instead of the photo, because I don't feel much of a use for photos on such a small screen, and sacrificing a color screen for more battery power just seemed like a better idea. Anyone else hit up this deal?
I picked up a 4G 40gb Ipod+HP. No regrets. I use my iPod strictly for music, not viewing photos. You may get increased battery life from the iPod photo if you use it strictly for listening to music, but viewing photos will significantly drain much of the juice anyway. And isn't that the point of having an iPod photo? Be happy that you own one of the last of the "pure" mass storage iPods specifically for audio.

Uh, you're wrong here.

The iPod Photos (with the color screen) have an estimated 15 hour battery life between charges, while the regular iPod only has 12 hours.

Where did you get the impression that the iPod Photos have a shorter battery life?
Color screen, the displaying of images, etc. I just assumed it would drain the life quicker, unless they upgraded the battery. It's just obvious to me that color displays use more energy than grayscale. My apologies if I'm wrong.

*shrug* they don't show the 40gig specs. None of those are accurate anyways, but I guess the bottom line is that I'll be getting around 9-10 hours realistically, while the Photo people will be getting around 10-12....roughly.

This is true; however, WHEN they run out is anybody's guess.

I have a friend who recently had his 3G unit replaced with a refurb. Looks like Apple's got an ample supply.

Actually, tests done on this site and others are showing Apple's estimated 15 hour battery life to be on the conservative side. Some people are reporting 21+ hours between charges for the Photo.

Colour screens DO use more power. They just improved the iPOD afterwards (better battery etc...), which is why the new one has up to 15 hours.

I do not think LCD is power eater (color or not) unless backlit. HD of iPod photo can consume less energy. Right designed firmware can also conserve a lot. Anyway, I'm waiting for 5G where I expect support more audio formats, better UI, better playlist manipulation, smaller size and battery life over 48 hours.
