i was wondering if the remote comes with the 40gig ipod, since i hear so many people have it, is it supposed to come with any ipod.

The earbuds will work with any iPod, but the remote will only work with the 3rd gen, 4th gen or Mini.

Yes, and becuase the recent iPods 3G, mini, and 4G have the input layout...
I don't have a picture, but a 1G and 2G look very different from a 3G, 4G and mini from the top....
