"Hold button" problem

I'm having a problem with the hold button on my ipod.
The problem is that the hold button will not release and the ipod is permanently locked.
I cannot reboot the ipod because the buttons are unreceptive due to the lock.
I upgraded the software and also restored the default settings to no avail; The ipod remains constantly locked.

The ipod works fine and plays music so long as I use the remote, however, I can't access the specific songs, playlists, etc.
Has anyone ever heard of this problem or know of any possible solutions?

I have a 2 year replacement plan via best buy, but intial steps seem to indicate that the entire process will be a big headache.
Does anyone have any stories regarding a BB warranty?

Any help will be greatly appreciated.
