I just recently got scammed. Seller claimed ipod touch was a 2g. Not only was it a 1g, but its a fake from china, with the word "ebay" engraved on the back . Is there a way I can prove its a fake? Apple said it was listed as an ipod touch 2g when I provided the number. If I can prove I was scammed perhaps I can can get a refund via paypal or my CC, which I used when I paid for it through paypal. Thanks!

Post the link to the auction so we can have a look.
If it states it was a genuine iPod and has photos of a real 2g Touch etc then you can get a refund.
If it was cleverly worded and included pictures of the fake then you are out of luck I would think.

Take pictures of your iPod touch from all sorts of angles and take pictures with the screen on that way we can see the OS. Post a link to the eBay auction as well. I suggest that you post them here first so we can take a look. Then, if everyone is in agreement you can go ahead and e-mail PayPal/eBay saying you received a fraudulent product.

Many thanks! I called apple and gave them the serial number. They told me it was authentic and registered with ebay and in fact was a 1G. Can it still be a fake? Thanks

So this was a model that Ebay ordered for itself? Like a company use iPod? I don't get why it would be registered to Ebay.

I'm beginning to think it's real but perhaps some Chinese grey market import ipod?

I don't know? It looks real. I never tried it because I want to return it for a refund. Serial # checks out. Its just strange that it has ebay engraved on it and it is registered to apple as ebay. Do you think it's just a authentic ebay discounted import? If so I never realized there are ipod imports. Thanks

Dude, just give us a picture already, a link to flickr or something.

And furthermore, can you stop saying discounted import.

If it shows as registered and in Apple's system, then obviously it's a real item, theyre not going to register an item that isnt theres......

What if someone bought a proper iPod touch and registered it to 'eBay' then engraved the genuine serial on a batch of fake iPods so if anyone contacts Apple it will show as legit even though its not.

Dude, just post a link to the auction/pictures already.

I hope you're not serious, I'm taking this as tongue in cheek, but that alot of work for someone to go through to sell a fake ipod.

Like others have said, we can't answer your question. We have to see the iPod touch and the link to the auction. You can still get a refund if the auction labeled the iPod as being a 2G iPod touch yet you received a 1G iPod touch.

Additionally, ALL iPods are made in China and say so on the back of them. So you can either post a link to the auction and pictures of your iPod or you can leave as we can't help you unless we see both the auction and pictures of your unit.

I agree, I mean even the link to the open eBay auction would be of use, me thinks this person has no idea how to do so

Buddy, just post up some pics. This information is totally useless unless you provide us some pics of the "fake" in question, more specifically the Serial and Settings>About, if you have it.

As documented by dozens of threads on this forum about lost iPods, Apple will not tell you who owns an iPod based on its serial number.

If an eBay logo is engraved on it, I wouldn't be surprised to have it be a unit given to eBay employees. Plenty of companies have done that. I believe Apple even does the engraving.

I'm starting to doubt the story.

They either don't know how to post links and go to image hosting websites, their iPod is the real deal and they just didn't know what an iPod touch looked like, or they found a description in the eBay auction saying that it was a 1G and not a 2G.

The whole ordeal seams a little strange. I think that the OP was just confused on the subject and decided to turn here first instead of taking the logical steps of rereading the auction page and taking pictures of their iPod if it didn't meet the description of the eBay auction.

Sorry guys I can't post a link. Ilounge won't let me because I am a new member. Here is the ebay item number: 140277531677 There is no actual picture of the ipod in the auction.
I won't post pics of it because I want to leave it just as I found it, in its John Lennon box so I could return it. I've had an ipod touch 1g, which I sold in favor of the 2g so I know what a 1g looks like. It's the ebay engraving and the fact that its registered with apple as ebay which is throwing me off. I have to look to see if said made in China. I'm not sure. Thanks

This is the link: ebay item (http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=140277531677) it's has a stock photo, but the description is of a 2G iPod Touch and it specifically mentions the Genius feature. (Looks like a scam to me - selling a 1G but describing it as a 2G).

But, here's another ebay item in a John Lennon Box (http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=230305211707) which is quite obviously a gen 1 iPod Touch.

Don't all the 2nd gen Touch's come in a small clear plastic case (like the one below) and not in a cardboard box?

So looking at the eBay auction, the text and picture both indicate it is a 2G Touch. If what you received is in fact a 1G Touch, then you have been misled and I think entitled to a reimbursement through eBay and PayPal. I would contact eBay immediately.

I don't think you have a knock-off or "fake" iPod. You just have a 1st generation (and an engraved one at that) when the auction specified a 2nd generation Touch.

Many thanks! I have opened up a claim through paypal. I just wonder how it would work. Would I have to send it to paypal to receive my refund?

I don't know the specifics, but I'm sure PayPal will explain it all to you. Certainly you will have to return the Touch to someone, most likely to the seller. I've only been through the PayPal resolution process once and that was when I paid for something that was never shipped and the seller disappeared and could not be contacted (so the resolution process was entirely one-sided). I'm sure the first step will be to open a line of communication with the seller to try to resolve the issue (obviously it can't be resolved any way other than a return and a refund since he had a misleading product description and photo on the auction, whether or not it was intentional on his part), but you'll still have to go through the motions.

Anyway, that's what Buyer Protection via PayPal is for, and eBay also has clear rules about misleading product descriptions / photos that cover exactly this type of scenario.

PayPal claims claims can take a while to process. More than likely you will have to ship the product back to the person who sold it using a track able method like UPS and give all of the shipping information to PayPal. They will then monitor your shipment and pay you back when it arrives back at the sellers doorstep. I ordered a fraudulent product on eBay that was about $250 (it was supposed to be a limited edition of a Robosapien but the person was actually selling me the standard edition). I had to ship the product back to the seller and give PayPal all of the tracking information. They didn't refund my money until the package was successfully received by the seller. It also took an additional few days for the processing of my refund. You can also call your credit card company and put a stop payment on your purchase or, if you used a debit card, go down to the bank and say that the product was fraudulent and they will put a hold on the charge so it won't get taken out of your bank account.

Sorry for being brash but you kind of just posted and never gave us further information when we consistently asked for it.

Pepsi had a promotion a few years ago to win an iPod mini with a Pepsi logo engraved on the back. All of these would have originally been registered to Pepsi even though they were giving them out. More than likely this is the same type of situation with eBay. They probably used them as a promotion for employees and someone didn't want theirs.

Did you ever try contacting the seller directly rather than just filing with Paypal? The seller may have been willing to work something out with you hadyou explained the situation. The seller may have just pulled info on the iPod Touch from Apple's website and not realized that they were selling a different generation. Even though most of what people hear are about scams and fraud, there are still a majority of people that are honest and would be willing to work things out.

Yes I have and he is willing to comply, but I found it carries more weight when you file a claim. It gives you some leverage. Thanks
