and also - if you have a defective touch, can you take it back to any apple store even if you don't have a receipt?
I'm thinking about getting a 16gb touch sealed in box w/ the new aps for $310 tax free (craigslist)

do the John Lennon 16gbs have the new aps?John was on my box but I did not have the apps installed (week #48 purchased two weeks ago from Costco). I think you have to go by the Model number on the box, where "/B" at the end means the apps are loaded.

Lennon does not mean Apps, look at the model number. I bought a Lennon one that had no apps.

No Lennon on the boxes were there before the application releases, funny enough wouldn't apple want to advertise these applications on the front of the box?

Mine is week 48, too, and had Lennon on the box. You gotta go by the model number like many others say.

I'd imagine so unless Apple has been mass-producing the 32GB model since before firmware 1.1.3 and software upgrade was released.
You don't need to know ahead of time, though. iTunes will tell you once you open the box and connect your new iPod touch to it. :D

If you don't have a receipt, Apple Stores won't give you an exchange or refund. You need to have a receipt for that. If you sync the iPod and it's registered in your name under your Apple ID, then they'll cover it under warranty: They'll fix it or replace it with an identical model.
And all 32GB iPod Touch units have the new applications.
16GB iPod touches may or may not have the new applications, but the retail price reflects the difference. A 16GB iPod *with* the new apps costs $399 and a 16GB iPod Touch *without* the new apps costs $379 --- So either way you're paying $20 for them.
