When in the store how do I identify a new touch that already has the updates verses an old one that I would need to pay $20 to update?

The older models with 1.1.2 still on them will have a part number of MA623LL/A (8GB) or MA627LL/A (16GB) on the box. The new ones that shipped with the 1.1.3 Software Upgrade will have part number MA623LL/B (8GB) or MA627LL/B (16GB).

Oh, and FYI, I just found out recently that all the retail channels that carry the old iPod Touch have supposedly been instructed by Apple to reduce the price by $20 to defray the cost of the January Software Upgrade. So if all they have are the old ones, ask them about it. I just got my wife a Touch that was $20 off the regular price and when I asked why they said that they had been reduced for that very reason. So either way you get a Touch with the upgrade for the same price.
