Search Google - posting links to illegal ROMs is a good way to get yourself banned by the mods...

Yes, ROMs are illegal even if you own the games. You are obtaining a game that was copied illegally through illegal download methods, this breaks the copyright of the game. If the game publisher offered up a ROM on their website then it would be legal but I have yet to see a publisher do that. If they do then they put their game up on Xbox Live Marketplace or the Wii's Virtual Console thus costing the customer some money.

The only legal way to obtain GBA games is to go out and purchase them. Use Google, it is your friend. That is the only support that we can offer without this thread getting closed and someone getting banned.

thats all fair enough, but I dont udnerstand how we can talk about one thing and not another. Jailbreaking, in essence is illegal in some way surelly? And to put other applications not warranted by APple is doing something wrong?? Then all of a sudden were not allowed to talk about Nes games? Give me a break, its been goin on for years.

Jailbreaking is still technically legal as you aren't violating Apple's EULA or copyrights on the iPod touch. Game ROMs however are clear violations. Just like you can talk about ripping audio CDs but you can't talk about downloading music from P2P or torrent clients. The last thing iLounge needs is a lock down from companies such as Sega, Nintendo, Atari, Acclaim, etc.

I haven't read Apple's EULA, but I'd be REALLY surprised if jailbreaking it wasn't illegal. As far as I know, all major software companies puts in a clause that legally protects its software from being "hacked".

Whether companies take any action doesn't make something legal or illegal either.

I think the jailbreakers are walking a fine line. Reverse engineering an application and re-releasing would be considered illegal. Adding software to the platform (just like you add Word or Firefox to your PC), wouldn't. The jailbreak (as I understand it -- at least for the 1.1.1 jailbreak) consisted of a bug in Safari that when triggered by a certain type of image file, gave the user access to the operating system which they then used to install SSH for file system access. Now how they figured out the password is beyond me :D

Sure, it is legal to install BitTorrent and to search for GBA ROMs. It is illegal to download those ROMs though as you are obtaining a game that violates its copyright. The only legal way to play NES, SNES, GBA, Genesis, Sega Masters, etc. games is to either lug out the old console and plug it into your TV or you download the games from a service such as Nintendo's Virtual Console. ROMs are illegal no matter how you look at it, plain and simple.
