Can I return my touch to Apple for an exchange without having to pay a restocking fee even though I have opened the package?

Not to the Apple store, unless there's a defect. They have a phone number... it's always best to speak with the primary source. Just saying...
Call Apple Care, they will let you either send it in OR make an appoitment with a genius. That way they can 'acknowledge' the defect and fix or replace the unit.
Stop asking questions and just take action. Trust me, you'll be glad you did. I am.
