I have a week 37 ipod touch with the screen problem....and i have been planning on exchanging it to get a new one without the screen problem. The firmware update the other day did indeed help the screen but I think everyone knows it did not make it look as good as the week 38 ipods and so on.
So what do I say to best buy now when I go to exchange it? I have to drive an hour and a half to exchange it so I want to make sure I will be able to.

Just tell them is randomly locks up and requres hard resets.
Since the 'lockups' occur randomly, they can't expect you to reproduce them, so they will have to take your word for it.
I've successfully returned several things to BB using the random lockup excuse. :D

But don't they have a 30-day return period? How could they have not let you return it? You don't even need to give a reason...as long as it's not smashed up you can return it!

Returning it is the best solution anyway. Why would you exchange? Returning and rebuying refreshes the 30 Day warranty too, just in case.

so returning it is the best thing to do? Walk up to the return table....return it....get your money back....walk right over to the ipods and buy a new one?
Also you can return it even if its been opened and used right? Ive used mine every day since I have had it. It has some scratches on the back chrome.

Don't worry, don't worry, exchange is pretty much equal to return and rebuy except they don't credit/charge you again. That's what they really do when you ask for an exchange.
The official policy is whether its opened or not, you can return it for any reason whatsoever - i.e. you don't like the way it smells, you regret buying it, whatever! That's the beauty of the store.
If you decide you want another touch because you think the one you have is defective, normally they would just get you a new one and that's it.
They won't give you any trouble if it's a bit scratched...it's normal wear and tear w/ the iPod.
The store actually PREFERS an exchange because if you return it, it's as if the salesmen sold you the "wrong product" so his stats will go down for returns. But hey, it's a free country!

You sure do! The 30 days starts over. And if you exchange it again, it starts over again too.
