im debating on whether to return it now or later..im afairad they probably dont have week 38's at my local best buy...

Look for the Macy Gray boxart.
And if you can see the box, look for if the box has "38" on it instead of 37 or 36 before you buy.

The Macy Gray boxes have been coming in flawlessly. People are satisfied. It's major.

Because if you notice, the people who bought their iPod touch's early had Corinne Bailey Ray (or something like that) on the boxart.
The new ones seem to have Macy Gray.

Should be the fourth and fifth serial numbers.
Weeks 36 are pretty bad.
Weeks 37 are mostly bad.
Weeks 38 (preorder shipments) are looking perfectly as of now.

Regarding the box designs, mine is a week 38 iTouch with the Corinne Bailey Rae cover. And mine was a preorder. BUT, the back of the box has a black sticker (with white text) over the area where the serial # info is (and also a sticker around the top part that explains the software requirements, etc.) Maybe they reused an older box and simply put the sticker with the newer info on it? The iPod itself has a week 38 serial number and has no screen/audio defects.

No, most week 38's are Corrine Bailey Rae. Mine is and everyone else that I know that pre-ordereed have the same box as me. My iPod is in perfect condition no screen or sound issue, so are my friends. I don't think the box has nothing to do with it, they probably ran out of the first designs and made a new box design, there was A LOT of orders

ONE GUY at macrumors forum says that his 38 still has a bad screen and you have taken it as your personal crusade to post this same thing in like 10 different threads here.

Actually, there was another person who agreed that their wk38 was also still having the issue. And I do think it's important to point that out since people seem like they feel guaranteed to get a perfect unit if it's week 38.

Then why don't you bring it up in the appropriate thread for discussion seeing as the overwhelming majority of week 38 users have good screens. Not a single person with a week 38 screen who is complaining has backed up with proof that they have a bad screen, for all we know they just don't know what they are looking for.
Seriously, it's not necessary for you to pop into 20 different threads with your cryptic "not ALL week 38s are good" and then put a link to a macrumors thread where one guy is #####ing.
All you're going to do is take the paranoid kids here and make them even more paranoid.

I just called my best buy where I got myself a nice shiny 36 week. It seems ok, but I am going return it. They told me the new shipments will be there Tuesday, along with Halo3 baby, so i will go return my unit today and get both on that day.

Best Buy just got new stock today! Woo hoo! I went to the store and looked at each of their units. They were ALL Week 37s. When I asked to look at their units, they said they JUST got stock about a minute ago, and he let me look through all the units so I got to see all the serial numbers. All the units had Corinne Bailey Rae with no Macy Gray ones and the serial numbers all were week 37s.

If this is true, then it means not all Week 38 units are perfect, meaning you still have to exercise caution with purchasing. That's logic, dumbarse.

Apparently you didn't read the thread, or you have comprehension problems. The one guy clearly explained how he tested it and knew what to look for. Then a second guy chirped in saying his week 38 also has a problem, though not as bad as his week 37 he had exchanged for it.

I picked up an 8GB/week 38 at Best Buy this morning. The screen looks fine, but I only really checked the Jay-Z image. Couldn't hear any hiss either, but my vision is much better than my hearing, so I can't be sure. Oh, and for the record, it had Corinne Bailey Rae on the box.

One of my friends whose an manager at our local Best Buy says their week 38's should be in some time next week.
