Battery out of warranty but within Settlement

My son's 3G 15G Ipod battery died yesterday. We've had the ipod for 18 months so the warranty is over but is within the additional year warranty as part of the Class actions settlement.

I've been on hte phone with Apple all morning getting nowhere.

Any suggestions how I can get this resolved?
