Not brand new, but broken parts are replaced with parts that work.
It sounds like you're looking to get a new ipod for free. My advise is avoid the headache. Apple is not stupid,, they're not looking to give 400 dollar units away for free. I'm sure there's someway to trick apple into relacing your ipod with a new unit, but i can promise you it wouldn't be easy, and without a lot of hassles and questions from apple. If you want a new ipod, sell the one you have on ebay, save up for a while to get the rest of the money, and buy a new one.
