Seems a bit unprofessional, that's akin to buying a new cd from a store with the wrong track names written on the back, not impressed at all! And three out of three of the books I've downloaded have the same issue.
Have to check the audio quality difference, but almost seems like the best thing to do for archiving would be to write to cd, rip it and implement my own chapter named m4bs. Ridiculous!
